What is the definition of Landlord and Tenant?

The landlord (or lessor party) of a property is the contractual party that leases the property. The person on the other side who receives that property is called the lessee (or lessee or lessee party).

When can the landlord terminate the lease?

Assuming that the individual contract regulates the rent and therefore carries all the enforceable rules, the landlord generally can terminate the contract either for the tenant’s default (public policy reasons, non-payment, etc.) or for his own reasons, such as the need to use the dwelling for himself or family members, to renovate or sell the property. All while always respecting the notice period contracted in each case.

When is the tenant entitled to the 18 monthly payments?

The tenant is entitled to the 18-month allowance when the landlord decides not to renew the commercial lease in order to use the property for himself or for other specific reasons. The relevant law is No. 392/1978 for leases for other than residential use.

How to evict a tenant with an expired contract?

First of all, notice must be given, by PEC or registered mail, of the intention to terminate the agreement, stating the date on which it expired and providing the tenant with a deadline within which to vacate the property. Before proceeding with the official and judicial paperwork of eviction, the landlord may attempt conciliation to shorten the time and reach a more peaceful resolution of the agreement.

When can the landlord enter the tenant’s house?

In the case of rental property, the law stipulates that the landlord may enter the house in which the tenant lives only under certain circumstances of urgent need. Failure to do so commits the crime of trespassing, which can be punished by imprisonment of up to 3 years under Article 614 of the Criminal Code.
