What guarantees must sellers provide in a real estate sale and purchase?

The seller must guarantee several things: that there are no third parties to have title to the property, that the property has no hidden defects, and that it adheres perfectly to the cadastral map and complies with all applicable regulations. In addition, the seller must certify that there are no encumbrances and that condominium expenses have been paid up to the day of the deed.

What happens if the seller or buyer fails to comply with the preliminary sale agreement?

In the event that either the buyer or the seller fails to comply with what was agreed to in the preliminary contract of sale, either of the two noncompliant parties can take legal action to demand the dissolution of the contract and also claim damages. It is also possible to request a compulsory transfer of the property or withhold the deposit.

What happens if a house has hidden defects in a real estate transaction?

How does a real estate purchase and sale take place?
